PRICES, DEADLINES, DELIVERIES AND LOSSES

Product prices

The product prices listed on the website www.senda.com.co include VAT and any other applicable taxes (applicable in the Republic of Colombia) . However, these prices exclude shipping costs and taxes imposed by authorities in other countries on sales made outside of Colombia.

For each order, Senda Nelly Rojas will charge the buyer a fee for processing and shipping costs. This fee will be indicated before confirming the order and making payment and will vary depending on the delivery location and the quantity of products ordered.

Shipping and insurance costs are the responsibility of the buyer.

To effectively insure your transport insurance and correct any delivery errors, it is essential that any incidents regarding the goods received or their packaging be noted in the observations section of the carrier's delivery document.

Product prices are subject to change without notice. Senda Nelly Rojas reserves the right to discontinue or modify products.

Any changes will not affect orders for which a shipping confirmation has already been sent.

Delivery times

Shipments are made via national and international courier services. Once the order is confirmed, it is prepared and dispatched.

For products in stock, shipping takes place the next business day after purchase is confirmed.

Delivery time for shipments within the Republic of Colombia will be 5 business days, and for international shipments, 7 business days, Monday through Friday, from the date the order is confirmed. Items subject to special or personalized orders may take longer than expected.

Orders shipped outside of Colombia may be subject to taxes and duties imposed by the destination country. These charges, based on the declared value of the order, are not included in the quoted shipping value and must be paid by the customer upon delivery if incurred. If the customer refuses to pay taxes and duties and the package is lost in customs, the customer will be responsible for the cost of returning it.

These delivery times are estimated and do not depend directly on Senda Nelly Rojas. Therefore, they may vary for logistical reasons, extraordinary circumstances, or force majeure. In the event of delivery delays, Senda Nelly Rojas will inform its customers upon becoming aware of them. Delivery delays will not be considered in cases where the order has been made available to the customer by the shipping company within the agreed timeframe and could not be delivered due to reasons attributed to the customer.

As soon as the order leaves the Senda Nelly Rojas warehouse, the customer will be sent an email notifying them that their order has been accepted and is being shipped with a tracking number from the shipping company so they can track it.

Shipping companies do not work on weekends, so for purchases made on Friday, the shipping process will begin on Monday.

Product delivery

Senda Nelly Rojas undertakes to deliver the order in perfect condition to the destination address indicated by the customer on the order form on the website.

If the delivery address provided by the customer on the order form is incomplete or incorrect, or if the information provided is invalid, a change fee will be applied to the customer.

If the customer is not present at the time of delivery of the product to the address provided, the courier company will inform the subscriber via the email address provided. The customer must contact the FedEx call center for details and schedule delivery.

If the customer has not been contacted according to the above specifications, the order will be returned to the warehouse, and the customer will be responsible for shipping and return shipping costs, as well as any handling fees.

Once the courier company delivers the package to the customer and they find any anomaly in the packaging that has affected the product, the customer must inform Senda Nelly Rojas, who agrees to notify the shipping company via email within 48 hours of delivery. After that point, incidents of this type will no longer be addressed (only for warranty items).

For claim purposes, it is important to have a photographic record of the condition in which the box was received and the damage caused to the product.

Loss of products.

If a shipment is partially or completely lost, Senda Nelly Rojas must be notified of the incident within 48 hours of delivery so that a claim can be filed with the courier company, who will then begin the relevant investigation.

For security reasons, no order will be accepted if the recipient and address cannot be identified.

PRODUCT AVAILABILITY

The number of units available for each product is kept up to date with warehouse inventory. Under no circumstances will Senda Nelly Rojas intentionally sell more units of products than it currently has.

If for any reason the product selected by the customer is not available after the order has been placed, the customer will be informed by email of the cancellation of the order for the unavailable product. It should be noted that the cancellation of an unavailable order does not entitle the customer to a complete cancellation of the order. In the event that

PAY

The customer agrees to pay the full value of the product at the time of placing the order in order for it to be shipped.

In the event of improper or fraudulent charges on the card used for purchases, the user must immediately notify Senda Nelly Rojas by phone or email so that the appropriate action can be taken.

The user is advised that the provision of a secure connection service for all purchase offers exempts Senda Nelly Rojas from liability for communication failures with banking or credit institutions, as well as from any damages that may be caused to users as a result of an action or omission by said entities. 

ORDER FORMALIZATION

Once the terms and conditions have been met and the purchase confirmation has been successful, Senda Nelly Rojas will send the customer an email with the purchase order and all the details.

ORDER CANCELLATION

Order cancellations will be accepted if requested prior to shipping (24 hours). To cancel, please send a request by email to servicioalcliente@senda.com.co .

Once payment has been made for the order, if the customer decides to cancel the product, they will be required to pay bank fees, which correspond to 12% of the order value, and financial fees attributed to the sale.

WARRANTY

Senda Nelly Rojas is obligated to comply with the terms established by law regarding the quality, suitability, safety, and good condition of the products offered. Therefore, the product warranty offered is 30 calendar days from the date of purchase and is limited to manufacturing defects.

For changes there are five (05) calendar days; the product must be in the original packaging and have not been used. The warranty on the products is thirty (30) calendar days for defects associated with materials, manufacturing and / or preparation under normal conditions of use. Senda Nelly Rojas does not make changes to products that are damaged by improper use such as blows, exposure to the elements, humidity, use of chemicals or failure to comply with the instructions indicated at the time of purchase and implied in the certificate of authenticity. The guarantee is covered by repair or change according to the discretion of SENDA Nelly Rojas and the provisions of the regulations that regulate the matter. It is cause for loss of the guarantee if the client decides to make modifications to the jewel and / or accessory.

Discounted or promotional products cannot be exchanged or returned.

WARRANTY DISCLAIMER

Senda Nelly Rojas will be exonerated from the liability arising from the warranty, when it demonstrates that the defect is due to:

  • Improper use of the product by the Customer (blows, falls or broken stones).
  • If the Customer has not followed the jewelry care instructions (see Jewelry Care).

REFUNDS AND RETURNS

Refunds

The refund will be equal to the cost of the returned products. Only in the event that the delivered product is defective or incorrect, Senda Nelly Rojas will also reimburse the customer for the corresponding shipping costs. Refunds will be issued through PayU or any other financial platform. 

Returns

Products purchased from Senda Nelly Rojas through its online store may be returned and refunded, provided the following conditions are met:

  • If the reason for the return is the responsibility of the Senda Nelly Rojas brand, because the product received is defective or does not correspond to the product ordered as confirmed in the order.
  • Notify the email address servicioalcliente@senda.com.co of your intention to return the product within 24 hours of receiving the order, indicating in the subject: RETURN REQUEST .
  • Return the jewelry within 3 business days of receipt to the address provided in response to the initial notification, and send a copy of the shipping label provided by the shipping company via email. Shipping costs will be refunded.
  • The product must be in perfect condition, retaining its original packaging and labeling.
  • For return shipments, the same box in which the product was received must be used. If the same box cannot be used, the customer must return the product in a box that protects the product until its final destination, ensuring that the product is returned with the best possible protection.
  • In addition, the customer must include a copy of the delivery receipt inside the package, indicating the returned products and the reason for the return.
  • SENDA NELLY ROJAS will only refund the customer the amount paid for their order and the corresponding shipping costs if the product delivered is defective or incorrect. The refund will be processed through our PayU payment platform in accordance with its refund and return policies, or through the technological platform of choice.
  • If the reason is another, the cost of these return expenses will be borne by the customer and they must communicate their intention to return to SENDA NELLY ROJAS within a maximum period of 24 hours after receiving the product. 

APPLICABLE LAW AND JURISDICTION

The provision of the website service and these General Conditions of Use and Purchase Policies of the Website and any specific ones that may be established, are governed by Colombian law. Law 1480 of 2011 "Consumer Statute". The Internet pages, their design and graphic presentation, are protected by the provisions of Law 23 of 1982, articles 12 and 30 and Decision 351 of the Cartagena Agreement (in the Colombian case) and by the provisions of the Copyright Act of 1976 of the United States of America.

  • If your purchase is received before 12:00 PM, it counts as a business day. After this time, it counts as the next business day, Monday through Friday. This delivery period begins when the product is shipped.
  • Items purchased at www.Senda.com.co will be shipped through an international courier company and will be delivered within approximately 3 to 7 business days.

  • Shipping costs are calculated based on the jewelry purchased.
